OPINION OF THE COURT

THOMAS M. COKER, JR., Circuit Judge.

THIS CAUSE comes before the Court on appeal of a conviction entered against Appellant, Anibal Colon for driving or being in actual, physical control of a vehicle while under the influence of an alcoholic beverage to the extent his normal faculties were impaired or with a blood alcohol level of .10 or above. The appellant was arrested on April 21, 1988 after the vehicle he was driving struck another vehicle which was stopped at a traffic light.
