This matter is before us as an appeal of the February 2, 2006, order of the Circuit Court of Mingo County by Mary Ann Komi-nar (hereinafter referred to as “Appellant”) in her capacity of administratrix of the estate of her deceased son, Jason Kominar. A six-member jury panel returned a verdict *547for the defense in the medical malpractice action brought by Appellant.
