This is an appeal from a judgment of the Supreme Court at Special Term, entered August 9,1972 in Albany County, which dismissed petitioners’ application, in a proceeding pursuant to CPLR article 78, to declare a determination of the respondent Commissioner of Environmental Conservation, granting a permit to fill in the Hudson River at 190 River Road, Grand View-on-Hudson, illegal and void and to direct that such permit be revoked and rescinded.
