I. INTRODUCTION

This case concerns the validity and applicability of a named driver exclusion in an automobile insurance policy. The pedestrian vice-tim of a hit-and-run accident involving an unlicensed and uninsured driver sued the driver's parents for negligently entrusting their vehicle to their son. The parents' auto insurance carrier refused to cover the victim's personal injury claim because the parents had previously excluded their son from coverage under the policy.
