PRATT, Justice.

James E. Pennock recovered damages against the New- house Realty Company for burns received from hot grease. The defendant company appealed. For a number of years Mr. Pennoek had been exterminating insects for the defendant company in the kitchen of their hotel. The gist of his action lies in the following quotations taken from his complaint:

«4. * * * that the said kitchen at said time and place was equipped with a tile floor which was maintained by the employees and servants of the defendant under the supervision and direction of the defendant in a smooth and highly polished…
