This cause comes on to be heard on the Respondents motion to dismiss and the Court is duly advised in the premises, finds that the Claimants complaint states on its face that Claimant was proceeding in an easterly direction at the time of the accident when his car was struck by one Rosemarie Timmermann, who was traveling in a northerly direction at the time of the accident.
