This matter is before the court on Plaintiff Carlotta Motsinger’s (“Motsinger”) Motion to Dismiss Counterclaim of Defendant Nationwide Mutual Insurance Company (“Nationwide”) [Dkt. No. 59] seeking a declaratory judgment regarding Mot-singer’s status as a Class I insured under her Nationwide insurance policies based on her allegation of a common law marital relationship.
