An action in ejectment, begun in 1914, to recover the two Osprey islands in Racquette lake, township 40, Totten and Crossfield’s Purchase, Hamilton county.

Two former actions were instituted in October, 1901, by the People aginst this defendant Joseph H. Ladew to recover these islands. One only of these actions was tried. 189 H. T. 355; reargument, 190 id. 543. Before the referee, in the action tried, the plaintiff succeeded. The judgment, affirmed by the Appellate Division without opinion, was reversed by. the Court of Appeals and a new trial granted, but none had. In, this condition of the…
