Facts.

DICKINSON, District Judge.

The facts upon which the present motion is based are as follows:

The Labor Board, constituted by the Transportation Act (Comp. St. Ann. Supp. 1923, § 10071% et seq.),.made an order fixing the wage scale of the members of the plaintiff organization by decreasing the then existing scale. The defendant, as preliminary to a conference with its employees for the purpose of establishing a new scale of wages, provided the machinery of an election for representatives.
