Exception is taken to the overruling of the certiorari to a judgment in a justice’s court against Dick Bowles. *839The first assignment of error in the petition for certiorari was, “that the account sued on consisted of an item from the year 1894 of $56.24, said item being the first item of the account for 1895, that excepting said item the account for the year in which the crop was made (1895) was paid, that no payment had been made by the cropper to the landlord but that .the landlord had sold certain portions of the crop raised and applied the cropper’s half of the proceeds to the payment of…
