KIRSCH, Judge.

Crystal West (“Crystal”) was injured in a workplace accident, when her coworker (“Michael”), while operating heavy machinery, hit the cherry-picker truck in which Crystal was riding, causing Crystal to fall twenty-nine feet and sustain catastrophic and permanent injuries.
