Introductory to a discussion of the actual issues posed in the appeal of Federal Deposit Insurance Corporation’s (hereafter “FDIC” or “creditor”) motions, we take note of the fact that in one form or another, this case has engaged the attention of federal courts for some eleven years. This extended delay in resolution has not been due to the complexity of the legal issues involved or the development of an extensive factual record.
