delivered the opinion of the conrt.

The plaintiff in error, Bernice Nelson, began an action of debt in the circuit court of Jo Daviess county against the defendant in error, B. E. Sutton. Upon issue being joined a jury was waived, and after the evidence was heard the court found in favor of the defendant in error and this writ of error followed.

On November 2, 1918, the defendant in error was served with a summons from the circuit court of Deuel county, South Dakota, to answer the complaint of the plaintiff in error which averred that on December 24,1917, the…
