*405In an action to foreclose a mortgage, the defendant Ruth Griggs appeals and the defendant Clarence Griggs purportedly appeals, as limited by the brief, from so much of an order of the Supreme Court, Kings County (Barasch, J.), dated November 21, 2002, as denied the motion of Ruth Griggs and purportedly of Clarence Griggs to dismiss the complaint pursuant to 22 NYCRR 202.27 and to cancel the notice of pendency filed on their property and granted that branch of the plaintiffs cross motion which was to restore the case to the trial calendar.
