This action comes before the Court on cross motions for partial summary judgment. In her claim against The Florida Bar, Florida Bar Foundation, Inc., and the Holland & Knight law firm, the plaintiff challenges the constitutionality of Florida’s Interest on Trust Accounts (IOTA) program, through which certain funds held in lawyers’ trust accounts are placed in interest bearing accounts to produce income for legal aid programs and other public purposes. 1 The plaintiff alleges that this appropriation of interest earned on her…
