OPINION

JONES, Chief Justice.

¶ 1 Lemuel Prion was convicted by a jury January 28, 1999, of first degree murder, kidnaping (dangerous), and aggravated assault (dangerous). The murder of Diana Vi-cari occurred between October 22 and October 24, 1992. The kidnaping and aggravated assault of Tabitha Armenia occurred at the end of 1992. Prion was acquitted of a sexual assault charge as to Tabitha Armenta. He was sentenced to death for the Vicari murder and to 21 years for the Armenta kidnaping, with a consecutive 15 year sentence for the aggravated assault. Appeal directly to this court is…
