Appeals from an order of the Supreme Court at Special Term, entered March 3, 1980 in Sullivan County, which denied defendant Witschard’s motion for summary judgment and granted plaintiff’s cross motion for summary judgment. By deed dated May 9,1973 and recorded in the Sullivan County Clerk’s office on June 6,1973, plaintiff allegedly purchased for value approximately one half of a parcel owned by one Edward Marscheider and situated in the Town of Rockland, Sullivan County.
