NIX, Judge.

Silas Barton Wright, plaintiff in error, hereinafter referred to as the defendant, was charged by information in the District Court of Pottawatomie County with the crime of obtaining a narcotic drug by fraud, second offense, tried before a jury, found guilty as charged and the punishment left up to the trial judge, who sentenced defendant to 5 years in the state penitentiary. The evidence reveals by the testimony of Joe Brasel, a pharmacist at the Marquette Pharmacy in Shawnee, that on October 20, 1956, defendant entered said pharmacy and presented a prescription, signed by Ned…
