This cause was before this court at a former term, when thq entry of the present appellee was sustained, and ⅛⅜ *157%mnner in which the claim should be surveyed determined. In carrying into effect the opinion of this court, the parties have taken a volume of testimony in relation to the head of a branch, which in that opinion was de-oided to he a locative and valid call from the evidence before the court.
