This is an application for a mandamus to compel the defendant-, as county surveyor, to survey for the petitioner, as adminis-tratrix of the estate of Benjamin E. Brewster, deceased, and by virtue of his headlight certificate, nineteen hundred and twenty acres of land, specially described in the petition, and including an improvement occupied and settled by the decedent in 1S35, and on which'lie continued to live until the time of his death, and which from that time has'been and is now in the possession of tlie petitioner.
