I. INTRODUCTION

Appellant in this case was charged with assault in the first degree. Appellant was .tried twice, the first trial resulting in a hung jury and the second in a conviction. Appellant failed to appear at sentencing and was arrested 14 years after the conclusion of the second trial and sentenced to a term of imprisonment. Appellant seeks to have his conviction set aside because the district court in his second trial refused to admit testimony relating to specific instances of the victim’s violent conduct.
