Appeal by the plaintiff, Damiano Musco, from a judgment of the Supreme Court in favor of the defendant, entered -in the office of the clerk of the county of Uew York on the 30th day of December, 1908, upon the decision of .the court, rendered after a trial at the Yew York Special Term, overruling the plaintiff’s demurrer to the answer and dismissing the complaint herein.

On the :27th day of June, 1907, one Ferrara was engaged in the selling of steamship tickets for transportation to foreign countries, *301and in conjunction therewith desired to carry on the business of receiving deposits of money for the purpose of transmitting the same to foreign countries.
