Appeal from Lonoke Circuit Court; G. W. Emerson, Special Judge; Where no supersedeas bond is filed appellant has a right to dismiss his appeal under the statute. This is an appeal from an order of the circuit -court granting appellee’s motion for1 a new trial. Appellant filed a stipulation, in accordance -with the terms of the statute, containing “an assent on the part of the -appellant that, if the order be 'affirmed, judgment absolute shall be rendered against the appellant. ’ ’ Kirby’s Digest, § 1188.
