TIPTON, J.:

[719] This is an appeal from the judgment entered on our mandate between the same parties. The opinion is reported in 355 Mo. 313, 196 S. W. 2d 278 and it affirmed the judgment on ' the cross-appeal, ‘1 otherwise the cause is reversed and remanded for further proceedings consistent with this opinion.” The facts con cerning the entire controversy may be found in' our opinion, supra. However, we will very briefly restate the essential facts. ■
