This was'an action commenced by the plaintiff in error, plaintiff below, against the defendants in error, defendants below, upon an appearance bond in a criminal case. By the terms of the bond Roy .Romaine, the principal, and the defendants as sureties, acknowledged themselves to be indebted to the state of Oklahoma in the sum of $500, “to be void,1 however, if the said Roy Romaine shall personally be and appear before the district court of Woods county on a certain day to answer to the charge of •grand larceny preferred against him, and to abide the order of the court, and make like…
