HILL, Judge.

Plaintiff has assigned error to the granting of defendants’ motion for summary judgment on two grounds. It first argues that “the uncontradicted facts in the pleadings, affidavits, deposition and transcript affirmatively showed that the defendant, Leonard Fisher, violated his fiduciary duties owed to the plaintiff as its general manager, agent, officer and director by purchasing for his own benefit those shares of stock which he had been directed to purchase on behalf of the plaintiff corporation.” Plaintiff then argues that the uncontradicted facts show that plaintiff had the…
