This is an action of contract in which the plaintiff seeks to recover from the defendant the sum of |1,000 which the plaintiff alleges he promised to pay her if she would not contest the will of their father, of which he was appointed executor by the testator. There was a verdict for the plaintiff and the *474case is here on exceptions by the defendant to the refusal of the presiding judge * to give certain rulings that were requested.
