This is an appeal from the assessment of the death penalty in a first degree murder conviction after a plea of guilty.
The defendant was a young, single man of Mexican origin of the age of 19 years. He was a strong, able-bodied man, very interested in sports with a special interest in boxing. On September 14, 1966, he was employed by Lincoln Landscaping, Ltd., and was assigned to the doing of yardwork at the Rohman home immediately north of the home of Mary O’Shea, the victim of the murder.
