Appeal by the plaintiff, Joseph W. Webber, from a judgment of the Supreme Court in favor of the defendant, the Franklin Brewing Company, entered in the office of the clerk of the county of ¡New York on the 15th day of February, 1907, upon the dismissal of the complaint by direction of the court after a trial at the ¡New York 'Trial Term.

The plaintiff appeals from a judgment dismissing his complaint after both parties had rested. The appeal is from the judgment only. ¡Neither party requested to go to ¡the jury, and no motion was made for a new trial. The action is to recover the value of certain articles which were removed from the premises 157 Bleecker street, in the city of New York, and to which plaintiff claims title. On July 13, 1899, the plaintiff leased the said premises to one Berti for a term of four years, with the privilege to the tenant to extend the term of the lease to ten years. Berti was a collector…
