The facts in this case, so far as they are material to a proper understanding of the question to be discussed, are as folloivs :
On the 7th of February, 1881, William H. McYeigh, of Alexandria, Ya., executed a bond, payable twelve months after date, to C. A. Baldwin, trustee for Mariah L. Baldwin, for the sum of $4,000, with interest at 7 p>er cent. To secure the payment of this bond, he conveyed certain real estate to Francis L. Smith, as trustee, and McYeigh having died, and Robert Munford having been substituted as trustee in the place of C. A.…
