— This suit was originally instituted by R. S. Rogers, plaintiff, 'who is the defendant in error here, against the St. Louis, Iron Mountain & Southern Railway Company, who is the plaintiff in error, and the Texas & Pacific Railway Company. The first trial resulted in a verdict and judgment in favor of both . railway companies and upon an appeal by Rogers to this court that .judgment was affirmed as to the Texas & Pacific Railway Company, but reversed and remanded as to the St. Louis, Iron Mountain & Southern Railway Company.
