On April 25, 2012, the Wisconsin Department of Natural Resources filed a motion to dismiss this case. The Court considered the motion on May 22, 2012, in conjunction with the hearing on confirmation of the debtor’s proposed chapter 11 plan.1 The basic issue raised by the DNR is one of timing. The case was filed on October 15, 2010. The petition designated the debtor as a “small business debtor,” which makes this a “small business case” within the meaning of 11 U.S.C. § 101(51C).
