— Appeal from a judgment of the Monroe County Court (Frank E Geraci, Jr., *1528J.), rendered August 20, 2008. The judgment convicted defendant, upon his plea of guilty, of assault in the first degree.

It is hereby ordered that the judgment so appealed from is unanimously affirmed.

Memorandum: On appeal from a judgment convicting him upon a plea of guilty of assault in the first degree (Penal Law § 120.10 [3]), defendant contends that his plea was not knowingly entered because the factual allocution failed to establish that he acted with depraved indifference.
