Appeal from an order of the Supreme Court (Sise, J.), entered May 22, 2006 in Hamilton County, which, inter alia, granted defendants’ motion for summary judgment dismissing the complaint.
In the fall of 1997, defendants repaved School Street in the Town of Long Lake, Hamilton County. Almost seven years later, in April 2004, plaintiffs, who own a house adjacent to that street, filed a notice of claim with defendants and, in September 2004, commenced this action in trespass, nuisance and negligence alleging that the repaving encroaches on their property by 5 to 10 feet and causes an increased…
