The appellant, Smith; sued Jaggers, and in the original petition alleged that he was the owner of labor No. 6, strip No. 3, league No. 102, of the Jeff. Davis county school lands in Cochran county; that Jag-gers, by force, had ejected plaintiff’s tenant from the premises and taken possession thereof, and was preparing to cultivate the land, claiming it as his own.
