Petitioner below, Thomas A. McEIwee & Son Inc. and John McEIwee (together appellants) appeal from the February 17, 2005 order of the court of common pleas, whereby appellee SEPTA’s preliminary objections were sustained and judgment was entered against appellants.

FACTUAL AND PROCEDURAL HISTORY
