This is an action of tort to recover damages for personal injuries, alleged to have been sustained by the plaintiff at about noon on April 8, 1931, on Morton Street, . Dorchester, Massachusetts. At the conclusion of the evidence the defendant duly moved in writing that the judge order a verdict for the defendant. This motion was denied and the defendant duly excepted. The jury returned a verdict for the plaintiff.
