The Appellate Division in its order permitting an appeal to this court, certified the following question for review: “ Does the complaint herein state facts sufficient to constitute a cause of action against the defendant? ”

Preliminary to a review of the allegations of the complaint reference must needs be made to certain provisions of chapter 813, Laws of. 1917, upon which the plaintiffs base their right to maintain this action.
