*582The plaintiff in error, hereinafter called the defendant, was convicted of involuntary manslaughter and sentenced to the penitentiary for four years.

On the night of December 24, 1923, between seven and eight o’clock, Thomas Martin Coleman, a young white man about twenty-one years of age, was driving a Ford automobile along the public highway in Nelson county. He was at the wheel, next to him sat his sister, and next to her, on the same seat, was Rev. Mr. Phillips. There was no one in the back seat.
