MARSH, District Judge.
On August 21, 1958, plaintiff, as administrator of the estate of Jesus Inostroza, deceased, brought an action under the Pennsylvania Wrongful Death and Survival Statutes1 to recover damages allegedly arising out of the death of the decedent. Jurisdiction was based on diversity of citizenship and an alleged amount in controversy in excess of $10,-000, exclusive of interest and costs.2
