BEAM, Circuit Judge.

Jeffrey Tokar was convicted in Missouri state court for the murder of Johnny Douglass and was sentenced to death. To-kar appeals from the district court’s 1 denial of his petition for a writ of habeas corpus under 28 U.S.C. .§ 2254. We affirm.

1. BACKGROUND
