The petitioner, John Hoppock, appeals from the dismissal, without an evidentiary hearing and without leave to amend, of his petition for relief under the Post-Conviction Hearing Act (Ill. Rev. Stat. 1979, ch. 38, par. 122 — 1 et seq.) or, alternatively, for relief from judgment under section 72 of the Civil Practice Act (Ill. Rev. Stat. 1979, ch. 110, par. 72). Accompanying this petition, was a petition for appointment of counsel. The Post-Conviction Hearing Act, by its terms, does not apply to misdemeanants.
