The defendant was convicted of the offense of larceny. The serious question presented on appeal is whether the trial court erred in refusing a new trial because of the misconduct of the state’s attorney.

The defense was charged with the larceny of a calf of one George Allerdings. It was described as a long yearling heifer, red with white face and a red patch around the right eye, weight of about 585 pounds.
