The defendant was convicted in the Court of Common Pleas on an indictment for procuring an abortion on one Mary Jane Fisher. The case comes up on a bill of exceptions for alleged erroneous rulings of the court below. The first two exceptions are based on the following grounds, to wit. : That the said Mary Jane Fisher was at the time of the alleged offence a single woman, having never been married ; that she afterwards intermarried with one Edwin A.
