This is an appeal from a habeas corpus proceeding instituted by Joseph L. Joseph against J. M. Puryear and wife, Nancy Puryear, to obtain the custody of his three year old daughter, Norraine Elizabeth Joseph. Shortly after obtaining a divorce from the appellant on the grounds of cruel treatment, the mother of the child died, leaving her with her maternal grandparents, appellees herein.
