T. T. Moore sued O. B. Carver for damages for fraud in the exchange of lands. Carver whose lands consisted of 8 sections of 640 acres each in Culberson county, through his agents, showed Moore level grazing lands in what was known as the Ed. Jones pasture, hut his deed conveyed to Carver 8 sections in a rugged, mountainous section several miles away from the lands shown him. The case was submitted to a jury on special issues, and upon their findings the court rendered judgment in favor of Moore for $22,014.28, from which judgment this appeal is prosecuted.
