After the making of the mortgage, and before bringing the suit in this case to foreclose it, Silverman became the owner of the mortgagor’s equity of redemption in the mortgaged premises, by purchase at sheriff’s sale under execution on judgment against the mortgagor, and was in the receipt of rents and profits as such owner of the equity of redemption. Silverman is perfectly solvent, and the mortgagee never had or demanded the possession of the premises.
