Appellant prosecutes this appeal from a judgment of conviction of murder in the second degree for ’killing Ms father, with punishment fixed fit 21 years in the penitentiary.

Joe Nagel, appellant’s father, was shot and Mlled in the dining room of his home in Perry County, on the night of September 9, 1928. In the afternoon of that day appellant, with his brother Henry Nagel, and upon his suggestion, went out into the woods' to hunt a bee-tree, and about two miles from home came upon Prank Wohlford, who was in his field looking over his crops, and he accompanied them.
