—In an action to recover damages for personal injuries, etc., the plaintiffs appeal from (1) a decision of the Supreme Court, Kings County (Schneier, J.), dated July 10, 2001, and (2) a judgment of the same court, dated August 24, 2001, which, upon the granting *351of the defendant’s application to set aside a jury verdict finding the defendant 60% at fault in the happening of the accident and the plaintiff 40% at fault in the happening of the accident, and for judgment as a matter of law, is in favor of the defendant and against them, dismissing the complaint.
