HEEN, J.

We affirm Defendant-Appellant Miles Yamashiro’s (Defendant) conviction after a second jury trial of the offense of Assault in the First Degree. Hawaii Revised Statutes (HRS) § 707-710(1) (1985). 1 Defendant was charged with the offense after he allegedly struck one Stephen DeSautel (victim) in the face with a golf club. Defendant’s first trial ended in a mistrial on September 29, 1989, when the jury could not agree on a verdict.
